Cookies

Our websites use so-called “cookies”. Cookies are small data packets and do not cause any damage to your terminal device. They are stored either temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your terminal device. Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your terminal device until you delete them yourself or they are automatically deleted by your web browser. In some cases, cookies from third-party companies may also be stored on your terminal device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g., cookies for processing payment services). Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies are used to evaluate user behaviour or display advertising. Cookies that are necessary for the execution of the electronic communication process, for the provision of certain functions that you have requested (e.g., for the shopping cart function), or for the optimisation of the website (e.g., cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6 para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 para. 1 lit. a GDPR and Section 25 para. 1 TTDSG); consent can be revoked at any time. You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited. Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you separately within the framework of this privacy policy and, if applicable, request your consent.

When you enter our website, a Borlabs cookie is stored in your browser, in which the consents you have given or the revocation of these consents are stored. The collected data is stored until you request us to delete it or you delete the Borlabs cookie yourself, or the purpose for data storage no longer applies. Mandatory statutory retention periods remain unaffected. Details on the data processing of Borlabs Cookie can be found at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/. For communication with our customers and other third parties, we use, among other things, the instant messaging service WhatsApp. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from gaining access to the communication content. However, WhatsApp does gain access to metadata generated during the communication process (e.g., sender, recipient, and time). We also point out that WhatsApp, according to its own statement, shares personal data of its users with its US-based parent company Meta. Further details on data processing can be found in the WhatsApp privacy policy at: https://www.whatsapp.com/legal/#privacy-policy. The use of WhatsApp is based on our legitimate interest in communicating as quickly and effectively as possible with customers, prospects, and other business and contractual partners (Art. 6 para. 1 lit. f GDPR). If a corresponding consent has been requested, data processing is carried out exclusively on the basis of the consent; this can be revoked at any time with effect for the future. The communication content exchanged between and on WhatsApp will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected. We have concluded a data processing agreement (DPA) with the above-mentioned provider.

ProvenExpert

We have integrated review seals from ProvenExpert on this website. The provider is Expert Systems AG, Quedlinburger Str. 1, 10589 Berlin, https://www.provenexpert.com. If you are logged into your Instagram account, you can link the content of this website with your Instagram profile by clicking the Instagram button. This allows Instagram to associate the visit to this website with your user account. We point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Instagram. Insofar as consent has been obtained, the use of the above-mentioned service is based on Art. 6 para. 1 lit. a GDPR and Section 25 TTDSG. Consent can be revoked at any time. The processing carried out by Facebook or Instagram after the transfer is not part of the joint responsibility. The obligations incumbent upon us jointly have been set out in a joint processing agreement. The wording of the agreement can be found at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the data protection information when using the Facebook or Instagram tool and for the data protection-compliant implementation of the tool on our website. Facebook is responsible for the data security of the Facebook or Instagram products. Data subject rights (e.g., requests for information) regarding the data processed by Facebook or Instagram can be asserted directly with Facebook. If you assert the data subject rights with us, we are obliged to forward them to Facebook. The data transfer to the USA is based on the Standard Contractual Clauses of the EU Commission. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Usage Policy. This enables Facebook to display advertisements on Facebook pages as well as outside of Facebook. This use of the data cannot be influenced by us as the site operator. The use of this service is based on your consent pursuant to Art. 6 para. 1 lit. a GDPR and Section 25 para. 1 TTDSG. Consent can be revoked at any time. Pinterest Tag

We have integrated Pinterest Tag on this website. The provider is Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland. Pinterest Tag is used to capture certain actions that you perform on our website. The data can then be used to display interest-based advertising to you on our website or on another page of the Pinterest Tag advertising network. For this purpose, Pinterest Tag captures, among other things, a tag ID, your location, and the referrer URL. Furthermore, action-specific data such as order value, order quantity, order number, category of purchased items, and video views can be captured. Pinterest Tag uses technologies that enable the cross-site recognition of the user for the analysis of user behaviour (e.g., cookies or device fingerprinting). Insofar as consent has been obtained, the use of the above-mentioned service is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and Section 25 TTDSG. Consent can be revoked at any time. 7. Newsletter

Newsletter Data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. For the processing of the newsletter, we use newsletter service providers, which are described below.

ActiveCampaign

This website uses ActiveCampaign for sending newsletters. The provider is ActiveCampaign, Inc., 1 N Dearborn, 5th Floor Chicago, Illinois 60602, USA. ActiveCampaign is a service with which, among other things, the sending of newsletters can be organised and analysed. The data you enter for the purpose of receiving the newsletter is stored on the servers of ActiveCampaign in the USA.

Data Analysis by ActiveCampaign

With the help of ActiveCampaign, we are able to analyse our newsletter campaigns. For example, we can see whether a newsletter message was opened and which links were clicked, if any. In this way, we can determine, among other things, which links were clicked particularly often. We can also recognise whether certain predefined actions were carried out after opening/clicking (conversion rate). For example, we can recognise whether you made a purchase after clicking on the newsletter. ActiveCampaign also enables us to divide the newsletter recipients into various categories (“clustering”). The newsletter recipients can be divided, for example, by age, gender, or place of residence. In this way, the newsletters can be better adapted to the respective target groups. If you do not want analysis by ActiveCampaign, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message. Detailed information about the functions of ActiveCampaign can be found at the following link: https://www.activecampaign.com/email-marketing. The privacy policy of ActiveCampaign can be found at: https://www.activecampaign.com/privacy-policy.

Legal Basis

Data processing is carried out on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time. The legality of the data processing operations already carried out remains unaffected by the revocation. The data transfer to the USA is based on the Standard Contractual Clauses of the EU Commission. Details can be found here: https://www.activecampaign.com/legal/scc and https://www.activecampaign.com/de/legal/gdpr-updates/privacy-shield.

Storage Duration

The data you have stored with us for the purpose of subscribing to the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data stored with us for other purposes remains unaffected. After you unsubscribe from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist if this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). Storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

Data Processing Agreement

We have concluded a data processing agreement (DPA) with the above-mentioned provider. This is a contract required by data protection law that ensures the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

8. Plugins and Tools

YouTube with Enhanced Privacy

This website embeds videos from YouTube. The operator of the pages is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. We use YouTube in enhanced privacy mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the enhanced privacy mode does not necessarily exclude the sharing of data with YouTube partners. Thus, YouTube establishes a connection to the Google DoubleClick network regardless of whether you watch a video. As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to associate your browsing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account. Furthermore, after starting a video, YouTube may store various cookies on your terminal device or use comparable recognition technologies (e.g., device fingerprinting). In this way, YouTube can receive information about visitors to this website. This information is used, among other things, to collect video statistics, improve user-friendliness, and prevent fraud attempts. If applicable, further data processing operations may be triggered after starting a YouTube video, over which we have no control. The use of YouTube is in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If a corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and Section 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information on the user’s terminal device (e.g., device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time. Further information about data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de.

Vimeo without Tracking (Do-Not-Track)

This website uses plugins of the video portal Vimeo. The provider is Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA. When you visit one of our pages equipped with Vimeo videos, a connection to the Vimeo servers is established. The Vimeo server is informed which of our pages you have visited. Vimeo also obtains your IP address. However, we have configured Vimeo so that Vimeo will not track your user activities and will not set cookies. The use of Vimeo is in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If a corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR; consent can be revoked at any time. The data transfer to the USA is based on the Standard Contractual Clauses of the EU Commission and, according to Vimeo, on “legitimate business interests”. Details can be found here: https://vimeo.com/privacy. Further information on the handling of user data can be found in the Vimeo privacy policy at: https://vimeo.com/privacy.

Google Fonts (Local Hosting)

This site uses so-called Google Fonts for the uniform display of fonts, which are provided by Google. The Google Fonts are installed locally. A connection to Google servers does not take place. Further information about Google Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

Font Awesome (Local Hosting)

This site uses Font Awesome for the uniform display of fonts. Font Awesome is installed locally. A connection to servers of Fonticons, Inc. does not take place. Further information about Font Awesome can be found in the privacy policy for Font Awesome at: https://fontawesome.com/privacy.

Google Maps

This site uses the Google Maps map service. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. To use the functions of Google Maps, it is necessary to store your IP address. This information is generally transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. When Google Maps is activated, Google may use Google Fonts for the purpose of uniform display of fonts. When Google Maps is accessed, your browser loads the required web fonts into your browser cache to correctly display texts and fonts. The use of Google Maps is in the interest of an appealing presentation of our online offerings and easy findability of the locations indicated by us on the website. The data transfer to the USA is based on the Standard Contractual Clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/. More information on the handling of user data can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. The purpose of reCAPTCHA is to check whether data entry on this website (e.g., in a contact form) is made by a human or by an automated program. For this purpose, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For analysis, reCAPTCHA evaluates various information (e.g., IP address, time spent by the website visitor on the website, or mouse movements made by the user). The data collected during the analysis is forwarded to Google. The reCAPTCHA analyses run entirely in the background. Website visitors are not informed that an analysis is taking place. The storage and analysis of the data is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and SPAM. Further information about Google reCAPTCHA can be found in the Google privacy policy and the Google Terms of Service at the following links: https://policies.google.com/privacy?hl=de and https://policies.google.com/terms?hl=de.

The use of iThemes Security is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the most effective protection of its website against cyber attacks.

For processing user enquiries through our support channels or live chat systems, we use Tidio (hereinafter “Tidio”). The provider is Tidio LLC, 180 Steuart St, CA 94119, San Francisco, California, USA. Messages you send to us may be stored in the Tidio ticketing system or answered by our staff in the live chat. When you communicate with us via Tidio, all data you entered before starting the chat (e.g., name or chat ID, address, and phone number) as well as your IP address, your country of origin, browser used, terminal device, website accessed, and the messages exchanged are combined in a profile and stored on Tidio’s servers. Messages addressed to us will remain with us until you request us to delete them or the purpose for data storage no longer applies (e.g., after your enquiry has been processed). Data Processing

For communication with our customers, we use online conferencing tools, among others. The specific tools we use are listed below. 11. Own Services

Handling of Applicant Data

We offer you the opportunity to apply to us (e.g., by e-mail, post, or via an online application form). In the following, we inform you about the scope, purpose, and use of your personal data collected during the application process. We assure you that the collection, processing, and use of your data is carried out in accordance with applicable data protection law and all other statutory provisions, and that your data is treated in strict confidence.

Scope and Purpose of Data Collection

When you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes taken during interviews, etc.) insofar as this is necessary for the decision on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation), and – if you have given consent – Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in the processing of your application. If the application is successful, the data you have submitted will be stored on the basis of Section 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of implementing the employment relationship in our data processing systems.

Data Retention Period

If we are unable to make you a job offer, you reject a job offer, or you withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular for evidentiary purposes in the event of a legal dispute. If it is apparent that the data will be required after the expiry of the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further retention no longer applies. Longer retention may also take place if you have given corresponding consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the Applicant Pool

If we do not make you a job offer, there may be the possibility of including you in our applicant pool. In the case of inclusion, all documents and information from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies. Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6 para. 1 lit. a GDPR). Giving consent is voluntary and has no bearing on the current application process. The data subject can revoke their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, unless there are statutory reasons for retention. The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.

Pursuant to Art. 6 para. 1 a.) – c.) GDPR, the organiser is entitled to collect, store, and transmit personal data if the data subject has consented to the data processing or if a contract or legal obligation is to be fulfilled.

The personal data of the participant will be stored and used exclusively for the conduct of the competition and will not be used for any other purposes, unless the participant has opted to receive a newsletter and has expressly consented to this use. Their data will only be transmitted to third parties insofar as this is necessary for the conduct of the competition (e.g., web agencies). Transmission to other third parties does not take place.
